Allgemeine Geschäftsbedingungen (AGB)

§1 Scope and seller

These terms apply to every contract for the purchase of courses, digital products and services between you (the customer) and:

(hereinafter “we”).

The learning content and the teaching are provided by Nam Deutsch from the Federal Republic of Germany, but your contracting party is the seller named above.

A “consumer” is a natural person who enters into a contract for purposes that are predominantly outside their trade, business or profession.

Diese AGB gelten für alle Verträge über Kurse, digitale Produkte und Dienstleistungen zwischen Ihnen und Lê Nam, Xã Nghi Lộc, Huyện Nghi Lộc, Tỉnh Nghệ An, Vietnam („wir"). Die Lerninhalte werden von Nam Deutsch in Deutschland erstellt und unterrichtet; Vertragspartner ist der vorgenannte Anbieter.

§2 Formation of the contract

The presentation of products on the website is not yet a binding offer. By clicking the order button and paying, you make an offer to enter into a contract. The contract comes into being when we confirm the order or grant access to the product. We store the contract text and send the order details to you by email.

Die Darstellung der Produkte stellt kein bindendes Angebot dar. Mit dem Absenden der Bestellung geben Sie ein verbindliches Angebot ab. Der Vertrag kommt mit unserer Bestätigung bzw. Bereitstellung des Zugangs zustande.

§3 Prices and payment

Prices shown on the website are final prices in Vietnamese đồng (VNĐ), inclusive of any taxes payable under Vietnamese law where applicable. You pay exactly the amount displayed at the time of ordering.

If you pay from abroad, your bank or card issuer may add a currency conversion fee or an international transaction fee. That charge belongs to your bank and is outside our control.

The payment methods and the due date are stated during the ordering process.

Die angegebenen Preise sind Endpreise in vietnamesischen Dong (VND) und enthalten die nach vietnamesischem Recht gegebenenfalls anfallenden Steuern. Etwaige Fremdwährungs- oder Auslandsentgelte Ihrer Bank sind nicht Bestandteil des Preises.

§4 Delivery and access

For online courses and digital products, once the contract has come into being you are granted access to the student area to view the content online. Courses and content you have bought can be accessed for up to 5 years from activation.

Books and materials are supplied for online reading in your account, with no download and no printing, unless expressly stated otherwise. For services, such as classes, the timing and the format are agreed separately.

Bei Online-Kursen und digitalen Produkten erhalten Sie nach Vertragsschluss Zugang zum Lernbereich zur Online-Nutzung, für maximal 5 Jahre ab Freischaltung. Bücher werden zum Online-Lesen im Konto bereitgestellt, ohne Download.

§5 Right of withdrawal within 14 days

You have the right to withdraw from the contract within fourteen days of its conclusion without giving a reason, in accordance with the “Withdrawal instructions” section below. This right may end early for digital content and services under §6.

We grant this right to every customer, wherever they live. For consumers habitually resident in the European Union it is a statutory right; for customers elsewhere it is a commitment we make in these terms.

Sie können den Vertrag binnen vierzehn Tagen ab Vertragsschluss ohne Angabe von Gründen widerrufen. Wir gewähren dieses Recht allen Kundinnen und Kunden unabhängig vom Wohnsitz; für Verbraucher in der EU besteht es ohnehin kraft Gesetzes. Das Erlöschen richtet sich nach §6.

§6 When the right of withdrawal ends early

Digital content (online courses, books read online): the right of withdrawal ends early if you have expressly agreed that we may open access before the withdrawal period expires, and have confirmed that you understand that by so agreeing you lose that right. For digital content you owe no compensation for value.

Services (such as classes): the right of withdrawal ends once we have fully performed the service, provided you had expressly agreed that we could begin before the withdrawal period expired. If you ask us to start the service within the withdrawal period and then withdraw anyway, you pay an amount proportionate to the service already provided.

Digitale Inhalte: Das Widerrufsrecht erlischt vorzeitig, wenn Sie ausdrücklich zugestimmt haben, dass wir vor Ablauf der Widerrufsfrist mit der Ausführung beginnen, und Sie Ihre Kenntnis vom Erlöschen bestätigt haben (vgl. § 356 Abs. 5 BGB). Ein Wertersatz ist bei digitalen Inhalten ausgeschlossen.
Dienstleistungen: Das Widerrufsrecht erlischt mit vollständiger Erbringung unter denselben Voraussetzungen (vgl. § 356 Abs. 4 BGB).

§7 Rights of use and copyright

All learning content — videos, texts, books, materials — is protected by copyright. You are granted a personal, non-exclusive, non-transferable right of use, solely for your own study.

Copying, unauthorised downloading, account sharing, distribution or public communication of the content in any form is prohibited without our written consent. If an account is found to have been shared without authorisation, we may suspend access until the matter is clarified.

Alle Lerninhalte sind urheberrechtlich geschützt. Sie erhalten ein einfaches, nicht übertragbares Nutzungsrecht ausschließlich zu eigenen Lernzwecken. Vervielfältigung, unbefugter Download, Kontofreigabe oder Verbreitung sind untersagt.

§8 Liability for defects

If a digital product or a service is defective, you have the rights granted by the applicable law. Please report the defect to us by email at info@frog-job.com; we will remedy it within a reasonable period or refund the corresponding amount if it cannot be remedied.

Bei Mängeln stehen Ihnen die gesetzlichen Rechte zu. Bitte melden Sie Mängel per E-Mail; wir beheben sie in angemessener Frist oder erstatten den entsprechenden Betrag.

§9 Limitation of liability

We are liable in accordance with the law for damage caused intentionally or by gross negligence, and for injury to life, body and health. So far as the law permits, we are not liable for indirect damage, loss of profit or loss of data arising from causes outside our control, such as a fault in your internet connection or in your equipment.

If you are a consumer habitually resident in the European Union, the mandatory mandatory liability rules of your place of residence are not affected by this clause.

Wir haften nach den gesetzlichen Vorschriften bei Vorsatz und grober Fahrlässigkeit sowie bei Schäden aus der Verletzung des Lebens, des Körpers oder der Gesundheit. Zwingende Haftungsvorschriften am Wohnsitz von Verbrauchern in der EU bleiben unberührt.

§10 Governing law and dispute resolution

The contract is governed by Vietnamese law. Disputes are settled first of all by negotiation via email at info@frog-job.com; if that produces no result, the competent courts in Vietnam have jurisdiction.

If you are a consumer habitually resident in the European Union, this choice of law does not deprive you of the protection of the mandatory consumer-protection rules of your place of residence, including the right of withdrawal set out in §5 and §6.

Es gilt vietnamesisches Recht. Bei Verbrauchern mit Wohnsitz in der EU bleibt der Schutz zwingender Verbraucherschutzvorschriften des Aufenthaltsstaates unberührt.

§11 Complaints

Complaints should be sent to info@frog-job.com. We reply to the email address you used when ordering and settle the matter directly with you. We do not take part in dispute resolution proceedings before a consumer arbitration body.

Beschwerden richten Sie bitte an info@frog-job.com. Wir sind nicht bereit und nicht verpflichtet, an Streitbeilegungsverfahren vor einer Verbraucherschlichtungsstelle teilzunehmen.

§12 Severability

If one clause is invalid, the remaining clauses stay in force.

Sollte eine Bestimmung unwirksam sein, bleibt die Wirksamkeit der übrigen Bestimmungen unberührt.
